End User License Agreement

THIS END USER LICENSE AGREEMENT ("EULA" OR "AGREEMENT") IS A LEGAL AGREEMENT BETWEEN YOU (EITHER AN INDIVIDUAL OR A SINGLE ENTITY) AND FAIRYFLOW.APP ("COMPANY", "WE", "US", OR "OUR") FOR THE FAIRY FLOW SOFTWARE APPLICATION ("SOFTWARE" OR "GAME").

BY CLICKING "I AGREE", INSTALLING, COPYING, OR OTHERWISE USING THE SOFTWARE, YOU AGREE TO BE BOUND BY THE TERMS OF THIS EULA. IF YOU DO NOT AGREE TO THE TERMS OF THIS EULA, DO NOT INSTALL OR USE THE SOFTWARE.

IF YOU ARE UNDER 18 YEARS OF AGE, YOU MUST HAVE YOUR PARENT OR LEGAL GUARDIAN READ AND AGREE TO THIS EULA ON YOUR BEHALF.

1. LICENSE AGREEMENT

Nature of Agreement

This EULA is a legal agreement for the licensing of the Software. The Software is licensed, not sold, and we reserve all rights not expressly granted to you. This Agreement supersedes any prior agreements or understandings, whether written or oral, regarding the Software.

This EULA incorporates by reference our Terms of Service, Privacy Policy, and Cookie Policy. Together, these documents constitute the entire agreement between you and us.

Acceptance

You accept this EULA by:

Clicking "I Agree" or any similar acknowledgment
Installing, downloading, or copying the Software
Using or accessing the Software in any way
Allowing a minor for whom you are responsible to use the Software

2. GRANT OF LICENSE

License Grant

Subject to your compliance with this EULA, we grant you a personal, limited, non-exclusive, non-transferable, non-sublicensable, revocable license to install and use the Software on compatible devices that you own or control, solely for your personal, non-commercial entertainment purposes.

Personal Use Only

This license is for your personal entertainment only and cannot be used for commercial purposes.

Device Limited

Install and use only on devices you own or control, subject to platform restrictions.

Scope of License

Single User License: This license is granted to you individually. You may not share your account or license with others.

Platform Restrictions: Your use is subject to the rules and policies of the platform (e.g., Apple App Store) from which you download the Software.

Updates and Patches: This license includes the right to receive updates and patches we make available, subject to any additional terms.

Beta Features: Access to beta or preview features may be subject to additional terms and may be modified or discontinued at any time.

Permitted Uses

Install the Software on your personal devices
Create and share gameplay videos for non-commercial purposes
Stream gameplay on platforms like Twitch or YouTube
Participate in community features and social elements

3. LICENSE RESTRICTIONS

You acknowledge that the Software contains proprietary content and information protected by intellectual property laws. You agree that you will NOT:

Prohibited Activities

Copy, reproduce, or distribute the Software
Sell, rent, lease, or sublicense the Software
Modify, adapt, or create derivative works
Reverse engineer or decompile the Software
Remove proprietary notices or labels
Use for commercial purposes

Create cheats, bots, or hacks
Interfere with other users' enjoyment
Violate any applicable laws
Use for data mining or scraping
Circumvent security features
Transfer to sanctioned countries

Technical Restrictions

You specifically agree not to:

Attempt to discover source code or bypass encryption
Access servers or networks without authorization
Use automated systems to access the Software
Exploit bugs or glitches for unfair advantage

Consequences: Violation of these restrictions may result in immediate termination of your license, legal action, and permanent ban from our services.

4. OWNERSHIP AND INTELLECTUAL PROPERTY

Ownership Rights

The Software, including all content, features, and functionality, is owned by fairyflow.app and is protected by international copyright, trademark, patent, trade secret, and other intellectual property laws. We retain all rights, title, and interest in and to the Software.

No Transfer of Ownership: This EULA does not transfer any ownership rights to you. You acknowledge that you are obtaining only a limited license to use the Software.

Protected Elements

Trademarks

Fairy Flow name, logo, and all related marks

Visual Assets

Characters, artwork, animations, and UI design

Audio Content

Music, sound effects, and voice recordings

Software Code

Source code, algorithms, and game mechanics

User Generated Content

If the Software allows you to create, submit, or share content ("User Content"), you retain ownership of your original content, but grant us a worldwide, perpetual, irrevocable, royalty-free license to:

Use, reproduce, modify, and display your User Content
Distribute your User Content through any media
Create derivative works based on your User Content
Use your User Content for promotional purposes

5. VIRTUAL GOODS AND IN-APP PURCHASES

Virtual Goods License

The Software may include virtual currency, items, or other goods ("Virtual Goods"). You acknowledge that:

Limited License: Virtual Goods are licensed, not sold, and you have no ownership rights
No Real Value: Virtual Goods have no monetary value and cannot be redeemed for real money
Non-Transferable: Virtual Goods cannot be sold, traded, or transferred to other users
May Expire: Unused Virtual Goods may expire after a certain period

PAYMENT TERMS

ALL SALES ARE FINAL. We do not offer refunds for Virtual Goods except where required by law.

• Prices include applicable taxes
• Payment processed through platform provider (e.g., Apple)
• You are responsible for all charges incurred
• Parental controls recommended for minors

Modifications to Virtual Goods

We reserve the right to modify, substitute, or discontinue Virtual Goods at any time without notice. We may adjust pricing, availability, or features of Virtual Goods for game balance or business reasons.

6. UPDATES AND ONLINE SERVICES

Automatic Updates

The Software may automatically download and install updates, patches, or new versions. These updates may be necessary for continued use and may include:

Bug fixes and performance improvements
Security patches and vulnerability fixes

New features and content
Game balance adjustments

Online Services

The Software may require or include online services such as:

Multiplayer features and matchmaking
Leaderboards and achievements
Social features and community events
Cloud save synchronization

Service Modifications

We reserve the right to modify, suspend, or discontinue any online services at any time without notice. We are not liable for any modification, suspension, or discontinuation of services.

7. WARRANTIES AND DISCLAIMERS

DISCLAIMER OF WARRANTIES

THE SOFTWARE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO:

• IMPLIED WARRANTIES OF MERCHANTABILITY
• FITNESS FOR A PARTICULAR PURPOSE
• NON-INFRINGEMENT
• ACCURACY OR RELIABILITY OF INFORMATION
• UNINTERRUPTED OR ERROR-FREE OPERATION

LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL WE BE LIABLE FOR ANY:

• INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES
• LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES
• COST OF SUBSTITUTE GOODS OR SERVICES
• DAMAGES EXCEEDING $100 USD

Your Acknowledgments

You acknowledge and agree that:

You use the Software at your own risk
We make no guarantees about availability or functionality
Some jurisdictions don't allow certain disclaimers
Your statutory rights may provide additional protections

8. INDEMNIFICATION

You agree to indemnify, defend, and hold harmless fairyflow.app, its affiliates, officers, directors, employees, agents, licensors, and suppliers from and against all claims, losses, expenses, damages, and costs, including reasonable attorneys' fees, resulting from:

Your violation of this EULA
Your violation of any third-party rights
Your violation of applicable laws or regulations
User Content you create or share
Your use of the Software

9. EXPORT CONTROL AND COMPLIANCE

Export Restrictions

The Software may be subject to export control laws and regulations. You agree to comply with all applicable export and re-export restrictions and regulations, including:

U.S. Export Administration Regulations
Trade sanctions and embargoes
Other international trade regulations

You may not use or export the Software to countries under U.S. embargo, to anyone on U.S. Treasury Department's list of Specially Designated Nationals, or U.S. Department of Commerce Denied Person's List.

10. TERMINATION

Termination Rights

This EULA is effective until terminated. It will terminate automatically without notice if:

You fail to comply with any term of this EULA
You violate our Terms of Service
We discontinue the Software
You request account deletion

Effect of Termination

Upon termination:

All rights granted to you under this EULA will cease
You must stop all use and destroy all copies of the Software
You will lose access to Virtual Goods and game progress
Sections on ownership, disclaimers, and liability survive termination

11. GENERAL TERMS

Governing Law

This EULA is governed by the laws of the United States and the State of Delaware, without regard to conflict of law provisions.

Entire Agreement

This EULA, along with our Terms of Service and Privacy Policy, constitutes the entire agreement between you and us.

Severability

If any provision is found unenforceable, the remaining provisions will continue in full force and effect.

Assignment

You may not assign this EULA. We may assign our rights to any successor or affiliate.

Modifications

We may update this EULA from time to time. Continued use after changes constitutes acceptance of the modified terms. We will notify you of material changes through the Software or other means.

12. THIRD PARTY NOTICES

Platform Providers

This EULA is between you and fairyflow.app only, not with platform providers (e.g., Apple, Google). Platform providers:

Are not responsible for the Software or its content
Have no obligation to provide support or maintenance
Are third-party beneficiaries with rights to enforce this EULA
May have additional terms that apply to your use

Open Source Components

The Software may include open source components subject to separate license terms. These licenses are available at:
